1. Introduction

 

1.1. These General Terms and GTC ("GTC") shall constitute the general legal framework for the use by the Registered Users of REDCROX and shall be binding on the Registered Users.

1.2. The capitalized terms when used herein shall have the respective meanings defined in Article 8 hereof.

 

 

2. Registration

 

2.1. The Registered User may solely be an individual. No registration of legal entities as the registered users is allowed.

2.2. The fundamental condition precedent for the use of REDCROX is the registration by the user. The use of REDCROX is solely allowed to the user who is duly registered on REDCROX (the "Registered User"). The registration shall be done on the relevant page REDCROX all in accordance with the Registration Rules.

2.3. For the purposes of completion of the registration, the applicant Registered User must pay the Identification Fee. The Identification Fee shall be paid in accordance with the Registration Rules in the amount specified therein. Company reserves the right to refuse registration of any applicant at its sole discretion.

2.4. Upon successful completion of registration, REDCROX will automatically generate a personal web account for the Registered User on RedCrox (the "Web Account") through which the Registered User will have the access to certain functionality of REDCROX accessible to Registered Users. The Registered User may access his/her Web Account with the use of the user name and password obtained by the Registered User from REDCROX during the course of registration (or in case of loss of password generated in accordance with the instructions on REDCROX). Company does not assume any responsibility nor liability in case of abuse of the Web Account of the Registered User. The Registered User shall keep the user name and password confidential. The Registered User shall bear any and all liability for any and all operations and actions which occur on the Web Account of the Registered User.

2.5. Each Registered User shall have solely one Web Account. Registered User may not in any case open another Web Account and may not register under different name or under different email address.

2.6. Registration of the Registered User may be immediately terminated by Company in any of the following cases:

a) breach by the Registered User of any obligation under these GTC,

b) breach by the Registered User of applicable law,

c) in case of attempting any manipulation or fraudulent activity in relation REDCROX (for example opening two Web Accounts, colluding with Shops, etc.),

d) in case of suspicion by REDCROX of any speculative Purchases by the Registered User, ore) cheating by the Registered User.

2.7. If the Registered User does not use the Web Account for any consecutive period of 12 months, then after these 12 months the Registered User's Web Account may be closed by the Company.

 

 

3. Verification of Identity; Money Laundering Requirements

 

3.1. Each Registered User warrants that:

a) he/she has full legal capacity; and

b) the details supplied when opening Web Account are correct; and

c) he/she is the rightful owner of Web Account and the rightful purchaser under the Purchase.

3.2. Company shall have the right to demand, at its sole discretion, at any time following the registration, that the Registered User shall provide Company with an evidence of its identity or its existence. For such purposes, Company may require, without limitation, a copy of the valid identity card of the Registered User. In addition, Company shall be entitled to require additional supplementary evidence of identity of a Registered User. Company may copy documents evidencing the identity or existence that has been provided to it and keep such copies on file. If the Registered User does not provide Company with such information then Company may suspend the Web Account until the Registered User has provided us with such information or permanently close the Web Account.

3.3. If Company is unable to confirm that the Registered User has the necessary age, then Company may

a) close the Web Account and

b) any Guesses made are void and the Registered User must return the winnings, if any.

 

 

4. Safety

 

4.1. The Registered User shall be obligated to comply with any and all safety rules. The Registered User is strictly prohibited:

a) to use the Web Account and/or REDCROX contrary to these GTC,

b) to use the Web Account and/or REDCROX in any manner causing damages to Company,

c) to transfer the Web Account to a third party,

d) to get or attempt to get user names and/or passwords of other Registered Users or Shops,

e) to abuse, block, modify or change the REDCROX,

f) to send or otherwise post unauthorized commercial communications (such as spam) on REDCROX,

g) to collect on REDCROX Registered Users' content or information using automated means,

h) to be part in any multi-level marketing, such as a pyramid scheme, on REDCROX,

i) to insert to the REDCROX data or information which are (i) false, (ii) misleading, (iii) fraudulent, (iv) infringing any third party's intellectual property rights, (v) defamatory (vi) inaccurate (vii) violating applicable law (including but not limited to consumer's protection and unfair competition), regulations and/or administrative arbitration or court decisions binding on the Registered User in this specific case, (viii) unlawfully threatening, (ix) obscene, (x) unethical (xi) containing child pornography and/or (xii) referencing to the products, services or websites which includes any of the foregoing data or information.

j) to upload files that contain viruses, Trojan horses, time bombs, corrupted files, or any other similar software or programs that may damage the operation of REDCROX or any third party's files, data, software, hardware or other property,

k) to bully, intimidate, or harass any Registered User or Shop,

l) to post content that is pornographic; incites violence; or contains nudity or violence,

m) to do anything that could impair the proper working of REDCROX,

n) to post content or take any action on REDCROX that infringes or violates someone else's rights or otherwise violates the law. Any such content may be removed by REDCROX,

o) to post anyone's identification documents or sensitive financial information on REDCROX and

p) to create a false identity.

The company cannot guarantee the safety of REDCROX.

4.2. Company will not be liable for any loss or damage which any Registered User may incur as a result of collusive, fraudulent or otherwise illegal activity, or cheating, and any action Company take in respect of the same will be at our sole discretion.

 

 

5. Other Rights and obligations

 

5.1. The Registered User shall be obligated to use REDCROX in compliance with these GTC and any and all applicable law.

5.2. Company shall be entitled to audit any and all performance of the Registered User on REDCROX. Company reserves the right to terminate at any time the Registered User's access to REDCROX as well as any ongoing Guesses on REDCROX in the event that the Registered User breaches any of its obligations set forth by the these GTC and/or the applicable law or in the event of technical or legal impossibility to continue with the operation of REDCROX. In addition, Company reserves the right to remove from REDCROX any and all data and information placed by the Registered User on REDCROX which are violating any of provision of the these GTC and/or applicable law.

5.3. The Registered Users shall, at its own cost, use such hardware and software platform which will enable the correct connection to REDCROX, and allow the proper utilization of the functionality of REDCROX in accordance herewith.

5.4. For the avoidance of doubt no Intellectual Property Rights related to REDCROX is or will be transferred to the Registered User.

5.5. The Registered User shall not insert to REDCROX data or information which are in any aspect infringing REDCROX or any third party's Intellectual Property Rights. The Registered User, at its expense, shall defend and hold harmless and indemnify Company and any of its affiliates, officers, employees, agents, advisors and consultants against all and any claims or justified demands (and any associated costs resulting therefrom) by a third party whose Intellectual Property Rights the Registered User has infringed or allegedly infringed by or in connection with the usage of REDCROX.

 

 

6. Limitation of Liability

 

6.1. The services provided by Company to the Registered User shall be provided „as is". Company does not provide any warranties related to the functionality and availability of REDCROX. Company does not warrant that: (a) REDCROX will be functional 24 hours a day 7 days a week, and that (b) REDCROX will be free of any errors and defects. For the avoidance of doubt, Company shall not be liable, including, without limitation, for and damages or any other negative consequences resulting from or associated with:

a) Registered User's breach of any of its obligation under these GTC;

b) any modification or destruction of data files, programs or other equipment, processes and/or disclosure of information of the Registered User caused by an accident, unauthorized access or illegal processes;

c) acts of any governmental authorities or courts; and

d) the denial or late issuance of necessary permits by applicable authorities.

6.2. Company shall not be liable for any input, transmission or evaluation errors. Company shall have the right to repair obvious errors in relation to Web Accounts. Company will inform the respective Registered User of the corrections immediately.

6.3. Any claims for damages resulting from for REDCROX system breakdowns, defects or improper data transmission raised by Registered Users against Company are excluded. Company shall not be liable for any indirect, consequential, punitive damages nor any loss of data. Any Company' liability is limited to the amount of the owed winnings to the respective Registered User.

6.4. Company further reserves the right to cancel guesses even subsequently if any such guess was won by the Registered User as a result of a technical error subject to Company being able to prove the technical error.

6.5. Company assumes no liability for damages whatsoever, arising through any abuse of the Web Accounts.

6.6. Company reserves the right to exclude any Registered User from participating in any of the competitions organized by Company at its discretion.

6.7. Company notifies Registered Users that making guesses by Registered Users may be subject to legal restrictions and even prohibition in some countries, even if Company has obtained the relevant permits. In particular, Company is not responsible for disadvantages whatsoever arising for the Registered User from the prohibitions thereof.

6.8. The Registered User acknowledges and confirms that any Purchase shall be exclusively a transaction and legal relationship between the Registered User and the respective Shop. Accordingly, Company shall not be part of any such transaction (Purchase), shall not incur any obligations under such transaction (Purchase) and shall not be liable and responsible for any performance or non-performance by either party to the Purchase (nor for any claims under warranties related to such Purchase). For the avoidance of doubt, Company shall not be liable and/or responsible for any consequences related to or arising as a result of:

a) the truth and legality of the Shop's offers, proposals and their business activity;

b) the quality, safety or legality of the items which are subject to the respective Purchase between any Registered User and any Shop;

c) the actual completion and fulfillment of the transaction between any Registered User and any Shop (including any warranty claims there under);

d) any breach of intellectual property rights in information or data supplied by any Registered User or any Shop;

e) any non-observance by any Registered User or any Shop of the relevant instructions or recommendations that Company may issue from time to time in connection with the use of REDCROX;

f) any breach of the Intellectual Property Rights in the goods and/or services which are offered for transaction or marketed by the Shop on REDCROX; and

g) failure by Registered User or the Shop to use such hardware and software platform which shall enable the correct connection to REDCROX, and allow the proper utilization of the functionality of REDCROX in accordance herewith.

6.9. Each Registered User confirms that he/she acknowledges that no express or implied warranties are provided and the use of REDCROX may bear certain risk, which is accepted by the Registered User.

 

 

7. Miscellaneous

 

7.1. The Parties agree that no agency, partnership, joint venture or employee-employer relationship is intended or created between the Registered User and Company.

7.2. If any provision of these GTC is determined to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions. The parties hereby agree to reach an agreement in respect of a new contractual provision in replacement of the original invalid and unenforceable one. Such new provision shall express, to the maximum legal extent possible, the will of the Parties reflected in such invalid or unenforceable provision.

7.3 These GTC shall be governed by and shall be construed in accordance with the laws of the Slovak Republic.

7.4. The place of performance for all obligations arising from Guesses is the Slovak Republic. Any disputes arising out of or in connection with the relationship between Company and any Registered User is subject to the jurisdiction of the court of Slovakia.

7.5. Each Registered User must agree to these GTC before completion of his/her registration process by clicking on the respective icon during the registration process. Anyone, who does not agree to these conditions, as mentioned in the previous sentence, may not use REDCROX.

7.6. Company may amend and/or supplement these GTC at any time in accordance with changes in the applicable legal and business environment and in accordance with its business policy. Company will publish the fully updated and valid text of these GTC from time to time on REDCROX. Each Registered User may express its disagreement to such amendments to these GTC in a written notice delivered to Company within 15 days from the publication of the amendments and/or supplements to these GTC on REDCROX. If the Registered User fails to do so, such amendments to these GTC shall become effective as of the date set forth therein, provided that the Registered User (i) following the receipt of such amendments to these GTC, performs any legal act towards Company, or (ii) continues to use REDCROX in a manner. If the Registered User notifies Company of its disagreement to amendments to these GTC within such time limit, Company shall be entitled to terminate any business relationship with the Registered User with immediate effect.

7.7. Each Registered User acknowledges that the following documents constitute an integral part of these GTC: the Guess the Winner Rules, Registration Rules, Payment Rules and Privacy Rules.

 

 

8. Defined Terms

 

The terms in this GTC commencing with capital letters shall have the meaning specified below, unless expressly specified otherwise:

a) Company means REDCROX s.r.o, registered and existing under the laws of Slovakia.

b) Guess means the pick by the Registered User of a Winner of a Golf Tournament in accordance with the Guess the Winner Rules.

c) Guess the Winner Rules means the then current Guess the Winner Rules issued by the Company and displayed on REDCROX.

d) Payment Rules means the then current payment rules issued by the Company and displayed on REDCROX.

e) Purchase means a purchase of goods or services by the Registered User in the Shop with the use of Link to such Shop or other purchase by the Registered User in the Shop using Registered User Code, provided that the purchase had been realized after the respective Shop became a member of REDCROX. The Purchase means purchase of all items included in one Confirmation.

f) Registered User shall have the meaning determined in the General Terms and Conditions.

g) Registered User Code shall mean the unique code attributed to the Registered User by REDCROX upon the completion of the registration on REDCROX.

h) Registration Rules means the then current registration rules issued by the Company and displayed on REDCROX.

i) REDCROX means web application operated by the Company at www.redcrox.com.

j) Shop shall have the meaning determined in the General Terms and Conditions Shopping Park.

k) Web Account means the personal web account attributed to the respective Registered User on REDCROX by Company upon the completion of registration by the Registered User with Company in accordance with the GTC.

 

 

9. Disclaimers

 

1. RedCrox.com contains (or you may be sent through the Site to) links to other web sites ("Third Party Sites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software and other content or items belonging to or originating from third parties (the "Third Party Applications, Software or Content").

Such Third Party Sites and Third Party Applications, Software or Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Sites accessed through the Site or any Third Party Applications, Software or Content posted on, available through or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies contained in the Third Party Sites or the Third Party Applications, Software or Content.

You provide information about yourself when you create an account on RedCrox.com, input it through your account or profile information, or otherwise provide content or information through our Services.

Registration & profile information

When you register for an account, we collect information about you, which may include your name, email, phone number, and/or password and other profile information.  When you create or modify your profile, you have the option of providing other information, such as a display name, profile photo, education, age, gender, zip code, devices, interests, and other details. 

You have choices about the information you provide to us. As an User, providing profile information helps you get more from our Services, including helping Customers to provide you with invites to participate in RedCrox games. It’s your choice to provide any information about you to RedCrox. 

Posting, uploading, and providing content

We collect personal information from you when you use our Services to post, upload, send, receive, share information, or fill out a form. For example, you provide information when you respond to a survey, participate in a RedCrox game, provide feedback, bug reports, messages, or other data. This content includes any information about you that you choose to include. You never have to post or upload personal data, though if you do not, it may limit your ability to participate in RedCrox game.

Customer support

The RedCrox Services also include customer support. When you contact support through email, website chat, or any other method, you will be asked to provide contact information, details about the issue you are experiencing, and other details to allow us to attempt to resolve your issue.

Payment information

For Users, we collect your contact and payment information (including name, address, phone number, PayPal email address, and other information) to facilitate any reward payments for participating in RedCrox games. You may choose not to provide this information, but it will impact your ability to participate in RedCrox games or receive reward payments.

We collect billing and payment information from Customers when you register for paid Services, including name and contact information. When you complete payment, you may also provide credit card information or other payment details, which are collected through our secure payment system.

 

Information we receive from other sources

We receive information about you from other sources, including other users of our Service, third party services, partners, and affiliates. 

Other users may provide information about you

Other users may provide information about you when they submit content through our Services. For example, if you are a User in a RedCrox game, you may interact with other participants through the RedCrox website,  within Customer apps or products, or otherwise. If you provide any of your information to other users, it is possible that they will provide this information to us within content that they post to our Services (e.g. a bug report, or a message). Do not provide any personal information to other users that you do not wish to be publicly available.

A RedCrox Customer may also provide us with your information (for example, your name and email), when inviting you to participate in a RedCrox game, or when inviting a coworker or associate to participate as an administrator within a Customer account.

Services that you link to your account

We receive information about you from third party services when you link or integrate a third party service to your account. For example, if you log in with Google or Facebook, we receive your name, email, and other information about you as permitted by your settings and the permissions and privacy policies controlled by these services. Be sure that you review all applicable privacy policies and settings from third party providers to fully understand what information may be shared to us before you do so.

Partners and affiliates

We may receive information about you and your activities on and off the Services from third party partners (for example, advertising, market research, or support partners), if you have given permission to those third parties to share information with others, or the information is extracted from publicly available sources. RedCrox may share limited information about you with partner third parties for the purpose of receiving additional information about you (data enrichment) so that we may perform or improve our Services or make our Services more personalized. For example, we may share your email with a third party to obtain some other information like your company name. For any third party vendors that we share information with, we sign a Data Protection Agreement to ensure information they process is adequately protected and lawfully obtained.

 

Information we collect indirectly when you use our Services

We collect certain information about you automatically when you use our Services. 

Information about how you use the Services

We log usage data when you visit our websites, apps, or other technology (e.g. click on a link, upload a file, view content, log in, interact with others, etc). 

Device, location, and connection information

We receive data from your devices and networks. We collect information about your phone, computer, tablet, or other devices you use to access our Services. For example, we get information about your mobile device hardware, the browser used, operating system version, and device features when you click a link to access an app download through our Service. When using our Service we also get information on your IP address, proxy server, device identifier, and your mobile carrier or network service provider. We use your IP address, phone number, and profile information to approximate your location and provide you with a better and more personalized service. 

Cookies, page tags, and other tracking technologies

We use cookies and other tracking technologies like web beacons, pixels, URL variables, device identifiers, and ad tags to recognize you and/or your devices as you use our Services. 3. How we use information we collect

We use your information to provide, personalize, support, and develop our Services. How we use your information depends on which Services you use, how you use those services, and the preferences you communicate to us. In the sections below, we provide details about the purposes and legitimate basis we have for using the information we collect.

To provide and personalize our Services

We use the information we collect from you to provide the Services to you, including authorizing access to our Services, processing transactions with you, and operating and maintaining our Services. For example, as an User, we use your information to facilitate your invitation and participation in RedCrox games that may interest you. We use the information we have about you (such as your profile information, including age, gender, zip code, devices, and other information you provide) to help Customers invite you and others (Users that match the Customer’s chosen target audience demographics, interests, or devices) to apply to participate in their project. 

For each RedCrox game, our Customers may manually define their target audience demographics and other requirements (e.g. devices) through the use of platform tools. We then use automated systems to facilitate the invite process and invite users that match the Customer’s requirements (or that we expect might meet the requirements).

To communicate with you or facilitate communication with you

We use your contact information to send transactional communications via email, text message, push notifications, and otherwise within our Services. For example, we use email as a way to distribute communications related to any projects you participate in (e.g. new tasks, surveys, due date reminders, reward notifications, etc). For our Customers, we communicate with you to confirm your purchase, provide support, and help ensure your projects are successful. We send email or text notifications when you or others interact on the Service (for example, when a Customer sends a message to a User). We provide unique communications to each user depending on how you use our Service. For example, we may send you unique communications to help you learn how to use a certain Service or make a suggestion that we think could improve your experience with our Service. In most cases, these transactional communications are an integral part of the Service and you cannot opt out of them. When you can opt out, you will see that option available and included within the communication itself (e.g. in the email footer for emails) or within your account settings.

To market and promote our services

We use your information to send promotional communications that may interest you, including by email and by serving you advertisements both on or off our Services. These communications are sent in order to allow you to use our Services more effectively, to increase engagement, and to allow you to learn more about our Services. Examples include newsletters, giveaways, information about new products or features, case studies, launch notifications, promotions, and contests. You can opt out of promotional communications using the unsubscribe link within each email, by updating your account settings, or by contacting our support team. You may be able to opt out of receiving personalized advertisements from other companies. We frequently conduct research to improve our Services and make them more useful to you and other users. We use usage data and direct customer feedback to learn about our users and improve our Service through user research, testing, and data analysis.

For security and investigations

We use your information for security purposes, to monitor or prevent or investigate fraud, verify accounts and activities, and to identify and research possible violations of policies or harm to our users.

When required by law or necessary to protect our legal rights and interests

We use your information when required to by law or in connection with legal claims,  compliance, regulatory, investigation, or audit purposes to protect our legal rights, our interests, or the interests of others. We may also disclose your information during the merger, sale, or acquisition process of our business or assets.

With your consent

We also use your information in any case you have given us consent to do so, even if it isn’t specifically listed above. For example, we may ask for your permission to share your contact information with a Customer that wants to invite you to be an ambassador or share your feedback in a testimonial.

Legitimate legal basis for processing for EEA users

We have legitimate basis for collecting, using, and sharing information about you. If you are located within the European Economic Area (EEA), we collect and use your information in compliance with EU laws. The legal basis for collecting and using your data depends on how you use our Services. We only collect and use your information when one or more of the following situations apply:

  • We need your information to fulfil our contract with you to provide and operate the Services you have requested as a Customer or User.
  • There is a legitimate interest provided that such processing shall not outweigh your rights and freedoms. Examples include:
  • To protect, monitor, prevent or investigate fraud or security threats
  • To market and promote our Services.
  • To protect our legal rights and interests.
  • For customer service.
  • Manage corporate transactions, such as mergers or acquisitions.
  • Research, understand, and improve our business or customer relationships.
  • You give us consent to do so for a specific purpose
  • The processing is necessary to comply with the law 

In situations where we rely on your consent to process personal data, you have the right to withdraw or decline consent at any time, however this will not impact any processing which has already occurred. Where we rely on legitimate interest, you have the right to object. However, this may mean you will be unable to continue using our Services. 4. How we share information we collect

Our Service is built for the purpose of facilitating RedCrox games for Customers and Participants, and sharing information through our Service and to certain third parties is critical to providing our Service. We do not sell your information to third parties without your permission, and your data is not disclosed to any third party except for the purposes described below.

 

Sharing with other users on our Service

We share certain information about you with other users on our Services.

Sharing with Users

We may share your username and profile picture with other Users and Customers before, during o rafter a RedCrox game. For example, a RedCrox game may include some shared collaboration spaces between all Users and the Customer (e.g. a message board, forum, feature request list, etc). Any content and information you provide through these shared spaces will be visible to other Users along with your username and profile picture. Other Users may be able to infer information about you, knowing that you are participating in the same RedCrox game they are (e.g. users of a video game test may infer that other users enjoy playing video games). 

If a RedCrox game will require that you share any additional information about yourself with other Users, the Customer must provide these details as part of the application process. Do not share any information about yourself with other Users that you do not want to be public. 

Sharing with Customers

We allow you to share your information with Customers when you apply to participate in a RedCrox game. We provide user research services to Customers, and an important part of user research is understanding user engagement, feedback, and testing in the context of additional information about that user (e.g. demographics, interests, etc). When you are invited to RedCrox games, as part of the application process, you can review which of your information will be shared with the Customer when you apply to participate. You can choose whether or not you want to apply to participate in a project and share your information with the Customer. 

When you participate in RedCrox game the collaboration features within our platform display some or all of your profile information to Customers. For example, when you submit a survey, a Customer can view your profile information, username, and see your profile picture. During a RedCrox game, you can also create content and post information in various ways, for example through surveys, bug reports, messages, forums or other methods. Any information you submit while participating in a RedCrox game will be shared with the Customer.

Sharing on public forums

Our Service offers some publicly accessible features to share and post content (e.g. forums, blogs, and support tools). Any information you provide on these public spaces, along with your username and image, may be read, stored, and used by any other person or tool that accesses these sections. Content in these sections may exist even after you terminate your account. To request removal, please see the appropriate sections below for more information.

 

Sharing with third parties

We share certain information about you with third parties that help us provide our services.

Sharing with service providers

We use third party service providers to help us provide our services (e.g. for website and app development, marketing, maintenance, payment processing, customer support, analytics, hosting, storage). These service providers will have access to your information as is reasonably necessary in order to perform services on our behalf and under the obligation that they do not use or disclose your information for other purposes.

Sharing with partners

We may share your information with affiliates and partners that provide sales, support, consulting, development, or other professional services so that they can perform their services. For example, we may share your information with a support partner to provide local support, or to a sales partner to provide sales support.

Sharing with third party apps, sites, and widgets

Our Service may include links that direct you to other websites, apps, or services with privacy policies that are different than ours. For example, a RedCrox game often contain instructions from a Customer to install, sign up, or use another third party website, app, or product. Any information that you may submit to a third party through a website or app is controlled by that third party and governed strictly by their privacy policies. For that reason, we encourage you not to provide real personal information directly through third party products you use during RedCrox game. We encourage you to use fake personal information (e.g. fake address), pseudonyms, and other non-personally identifiable information when providing content through third party products. In the event that the Customer requires your real information, this should be communicated and understood before applying to the project. If you are ever uncomfortable about providing information during a RedCrox game, please do not. It is always your choice to decide whether or not you want provide information that is requested of you, however it may mean that you need to opt out of RedCrox.com.

Our Service may use third party widgets or plugins to provide additional functionality and features (e.g. social media sharing with a Facebook or Twitter button). These third party tools often collect information about your website usage. For example, they may set a cookie, and collect your IP address and information about which pages you visited on our website. These third party widgets or plugins may be hosted by a third party or directly on our services, but your interactions with those features are governed by the privacy policy of the company providing those tools.

Sharing when it’s required by law or to protect the rights and safety of us, you, or third parties.

We may need to share your information when required to by law or in connection with legal claims, compliance, regulatory, investigation, or audit purposes to protect our legal rights, our interests, or the interests of others. 

Sharing in connection with a merger, sale, or financing event

We may also disclose your information during the merger, sale, or acquisition process of our business or assets. In this event, we will send notification via email or place a prominent notice on our website along with any choices you may have regarding your information. 

 

5. Information security and retention

Information security

We use data hosting providers in the United States and take precautions to protect your information and prevent the access, misuse or loss of your data. Our network infrastructure includes safeguards such as Secure Socket Layer (SSL) technology, hardware and software firewalls, DDos mitigation, data encryption, monitoring and logging, identity and access control, redundancy and backups, intrusion detection, and other security controls. The hosting providers we use are certified by third party security audits such as SOC 2, SOC 3, ISO 27001 and other.

No security system is impenetrable. Although we try hard to keep your data private and secure, due to the nature of the internet and associated risks, we cannot warrant the security of any information you provide to us. 

Retention of your information

We keep your account information as long as your account is open or as long as it is necessary for our operations. We retain some information as needed to comply with legal or business obligations, enforce our rights and agreements, maintain security, and take other actions permitted by law, up to the maximum terms permitted by law. After those terms, your information will be fully deleted or anonymized, or to the extent that this is not possible (e.g. the information is stored in backups or archives), we will securely store your information until it is possible to delete it fully.

 

6. Your rights to access and control your information

You have choices and rights to access and control your information. You can access or delete your personal data and have choices about how your data is collected, used, and shared. In the sections below, we provide details on how you can exercise your rights and make requests related to the access or control of your information. You can exercise some of these choices directly within your account settings, and for all other requests by contacting us directly as described in the Contact Us section below.

In some cases, your choices may be limited and your requests may not be able to be fulfilled. For example, if you ask us to delete information which we are permitted by law to maintain or have legitimate interests to keep as described within this privacy policy. When you have shared your information with third parties through our Service, those services control your data and you must contact those third parties to have your information deleted or restricted. 

Change or correct your information

You can access and edit some of your personal information through your account. For example, you can access, change, and update your profile information or fix it if it is inaccurate. You can also ask us directly to change or correct your information by contacting us directly as described in the Contact Us section below.

Delete your information

You can delete certain information about you through your account. For example, you can remove content that you submit through surveys or delete certain profile information. You can also ask us directly to delete your information by contacting us directly as described in the Contact Us section below. In some cases we may need to retain your information. For example, if you ask us to delete information which we are permitted by law to maintain or have legitimate interests to keep as described within this privacy policy. 

Right to data portability

You can ask us for a copy of your personal information in a machine readable format, and you have the right to transmit your information to another provider. Depending on the context (e.g. the specific information and our legal basis for processing), this right does not apply to all of your information. Upon request, we will provide you with an electronic file in machine readable format that includes your basic account profile information and content that you have submitted through User Research Projects. 

Close your account

You can close your account through your account settings or by contacting us directly as described in the Contact Us section below. In some cases we may need to retain some of your information (e.g., if necessary to meet our legal obligations, fulfil regulatory requirements, maintain security, encourse our rights, prevent fraud or abuse, or to allow you to unsubscribe from communications). We do retain de-identified information after your account has been closed. Information that you have shared with others will remain visible through the platform (e.g. survey feedback, bug reports, messages), but be re-associated with an anonymous user account.

Request that we stop accessing, storing, or using your information

You can ask us to stop accessing, storing, using, and otherwise processing your information if you think we do not have the rights to do so, or to limit our use of your information.  When you gave us consent to use your information for a limited purpose, you can withdraw that consent. If there is a delay in resolving your request, or if we dispute your request because we feel that we have the right to continue using your information, we will limit further use of your information until the dispute is resolved.

Opt out of communications

You may opt out of receiving promotional emails from us by using the unsubscribe link within each email, by changing the settings within your account, or by contacting us as described in the Contact Us section below. After you opt of receiving promotional communications, you may still receive transactional messages regarding our Services.

You may be able to opt out of personal advertisements from third party companies who participate in industry opt-outs including the Digital Advertising Alliance and others. “Do Not Track” signals

DNT is a feature implemented in some browsers that is designed to request that websites disable tracking or cross-site tracking of individual users. Like most of the industry, we currently do not respond to DNT signals in browsers because, although efforts are underway to consider standardization of DNT by the World Wide Web Consortium, no DNT standard has been adopted and there is not yet a common understanding of how to interpret the DNT signal.

7. How we transfer information internationally

We collect and use information globally and store your information in the United States. By using our Service you expressly consent to the transfer and processing of your information in the United States. In providing our Service, we may also transfer, store, or otherwise process your information wherever our third party service providers operate, which may be a different country than where you reside and may not have data protection laws that provide the same level of protection as countries in the European Economic Area. Your consent is voluntary, and you have the right to revoke your consent by opting out at any time and discontinuing use of the service. Payments

Introduction

 

  1. Any payment paid on REDCROX may be done solely by one of the methods specified herein.
  2. The capitalized terms when used herein shall have the respective meanings defined GTC.

 

Payment methods

 

  1. PayPal
    1. Any winnings up to the amount of 299 Euro will be paid by REDCROX to the Registered User through PayPal.
    2. The Registered User must provide to REDCROX the following information in order to enable payment through PayPal:
    3. Paypal account registered e-mail address
  2. Bank Transfer
    1. Any winnings above the amount of 299 Euro will be paid by REDCROX to the Registered User through the Bank Transfer.
    2. The Registered User must provide to REDCROX the following information in order to enable payment through Bank Transfer: name and surename of Account Holder and address of the bank IBANSWIFT
    3. Before the first payment is made, REDCROX will request a copy of official identity card (Passport or National ID card) which includes a photo of the Registered User by fax or scanned by email.

 

 

Registration rules

Introduction

 

1. The registration on REDCROX shall take place in accordance within these Registration Rules ("Registration Rules").

2. The capitalized terms when used herein shall have the respective meanings defined GTC and Shopping Park Rules.

3. The registration is made on the relevant page of REDCROX.

 

 

Registration: shops

 

1. The shops shall register as follows:

  1. The Shop shall complete the relevant registration form. All the data indicated in the form as mandatory must be properly filled in. All the information inserted in the form must be true and correct.
  2. Upon completion of the form, the acceptance of the Shopping Park Rules must be confirmed by the Shop by clicking to the respective confirmation field.
  3. The Shop shall duly fill in the Referral Agreement and send the signed Referral Agreement scanned by email to [email protected].
  4. The Referral Agreement is valid, if accepted by the Company. The Referral Agreement is accepted by the Company, when REDCROX opens the Web Account for the Shop.
  5. Upon opening Web Account, REDCROX will send by email to the Shop:

               5.1. instructions how to operate the Web Account,

               5.2. user name and password to the Web Account,

               5.3. electronic bridge code.

      6. Upon occurrence of the aforesaid, the Registration of the Shop is completed.

2. The Shops shall be obligated to implement the received electronic bridge code to its Shop web page immediately after completion of the Registration, within 15 days from completion of the registration at the latest.

3. Company reserves the right to refuse registration of any applicant shop at its sole discretion and also reserves the right not to sign the Agreement with any applicant shop.

4. In case of loss of user name or password, the Shop shall proceed in accordance with the instructions on REDCROX.

 

Registration: users

 

The registered user shall register as follows:

  1. The applicant Registered User shall complete the relevant registration form. All the data indicated in the form as mandatory must be properly filled in. All the information inserted in the form must be true and correct.
  2. Upon completion of the form, the GTC must be confirmed by the applicant Registered User by clicking to the respective confirmation field.
  3. The Registered User must pay the Identification Fee in the amount equal to 1.00 EUR. Company will return the paid Identification Fee (within 30 days) to the Registered User. Company reserves the right to change the amount of the Identification Fee at its sole discretion. The new amount of the Identification Fee will be applicable to any new Identification User after the publication of the new amount of the Registration Fee on REDCROX.
  4. Subject to fulfillment of the aforesaid steps, REDCROX opens the Web Account for the Registered User and attributes to the Registered User the unique Registered User Code.
  5. Upon the occurrence of all the above, the registration of the Registered User is completed.
  6. Company reserves the right to refuse registration of any applicant-registered user at its sole discretion.
  7. In case of loss of user name or password, the Registered User shall proceed in accordance with the instructions on REDCROX.

 

Miscellaneous

 

1. The Registration Rules shall be governed by and shall be construed in accordance with the laws of the Slovak Republic with the exclusion of the reference laws of international private law.

2. The Registration Rules shall create an integral part of GTC and Shopping Park Rules.
